AUTOMATED RED LIGHT CAMERA ENFORCEMENT PROGRAM

 

What is a Red Light Camera Enforcement Program?

This is a traffic safety program in which a city uses a state-of-the-art digital camera and violation detection system installed at intersections for the purpose of decreasing the number of red-light runners and reducing collisions.

Why are they used?

According to the Insurance Institute for Highway Safety red light running is a leading cause of urban crashes and often causes injury and death.  Cities install the system to improve public safety by deterring red light running.

What is a red light violation?

A red light violation occurs when a vehicle crosses the legal violation point and proceeds through the intersection after the traffic light has turned red.  It is not a violation if the vehicle has entered the intersection prior to the signal turning red (such as to complete a left hand turn).

How does it work?

Each intersection is outfitted with a high resolution high speed digital camera.  The cameras are activated by sensors which are located at the intersection and are only activated when a vehicle is detected by the sensors after the light has turned red.  The cameras take two digital photos which document the violation and are mailed with a citation to the registered owner of the vehicle.  The program operates 24 hours a day seven days a week and operates in all weather conditions.  The system is only activated when a vehicle runs a red light and all intersections with red light cameras are clearly marked with photo enforcement signs.  The Baton Rouge Police Department reviews every violation before the citation is issued.  Citations contain images of the violation vehicle before it enters the intersection, while it is in the intersection and the license plate.

Are Red Light Cameras effective?

Yes.  Red light cameras have been proven to be effective in reducing red light violations and right-angle crashes.  Cities using these systems consistently report safer roads with fewer intersections collisions.

If I am already in the intersection when a light turns red, will I get a citation?

No.  Citations are only issued when a vehicle enters the intersection AFTER the light has turned red.  If you enter the intersection a green or yellow light you will not be photographed by the camera system.

Who receives the citation?

Citations are mailed to the registered owner of the vehicle.

What is the amount of the fine?

The fine for a Red-Light camera violation in Baton Rouge is $117.00. For the second or subsequent violation of the same plate within 12 month period, the fine amount is $167.00.

If a payment is not received by the due date printed on you notice a delinquent notice will be send and late fee of $35.00 will be added to the amount due. If the delinquent notice is not paid by the due date a pre collection notice will be send and an additional $15.00 will be added to the amount due.

How can I dispute this citation?

Detach the coupon below, sign it and mail it in the enclosed envelope with any supporting documentation to the address on the coupon below so that it is received by the due date on this Notice. You will be notified in writing of the date, time and location of your hearing. Pursuant to Ordinance No. 11:54 , if you are found liable after the administrative adjudication hearing or you request a hearing but fail to appear at the time and place of the hearing, you will be liable for an administrative hearing fee in the amount of $ 50.00. If you are found liable for the civil penalty after an administrative adjudication hearing, you shall pay the civil penalty and all costs immediately.

I am registered owner but was not driving the vehicle at the time of the violation.

 

IF AT THE TIME AND PLACE OF THE VIOLATION THE VEHICLE WAS BEING OPERATED BY A PERSON OTHER THAN THE OWNER, the owner may transfer liability for the violation to the person who was operating the vehicle at that time and place of the violation if the owner submits to the Violation Processing Center or the hearing officer, an Affidavit of Non-liability upon a form , or testimony under oath at an administrative adjudication hearing, sufficient to establish that a specified person other than the owner was the operator at the subject time and place. An Affidavit of Non-Liability form must be submitted before the due date; a form can be obtained in the following way: Print the form from the website: www.ViolationInfo.com. You will need your Notice # and PIN # printed on the front of the Notice.

 

All Affidavits of Non-Liability shall include the following applicable information:

a. Name and address of person operating the vehicle at the time and place of the violation; or

b. Name and address of the lessee/ rentee of the vehicle at the time of the violation, if the vehicle was leased or rented from a person in the business of renting or leasing motor vehicles at that time; or

c. Name of the subsequent owner of the motor vehicle, if ownership of the vehicle was transferred by the owner before the time of the violation, with supporting documentation of sale

d. Copy of the police report if the vehicle or plate was stolen.

 

How do I pay my fine?

PAYMENT IN PERSON: You may pay in person with your check or money order at City Court located at 233 St. Louis Street Baton Rouge, LA Room 102.

Your payment must be received on or before the due date shown on the front of your Notice of Violation

What is the Refund Policy?

A refund check may be issued under the following circumstances:

  • Duplicate and/or overpayment of a Notice of Violation
  • Overpayment of the Notice of Violation as a result of a Hearing.

If you feel as though you are entitled to a refund, please submit your request on the Red Light Refund Form . Send the completed form to the address specified at the top of the form.
